SCOTUS Remand in Oneida Should Yield a Win for Cayugas

Today's decision by the U.S. Supreme Court to remand Madison County v. Oneida Indian Nation to the Second Circuit Court of Appeals leaves intact that Circuit's affirmation of tribal sovereign immunity from state property right enforcement action, at least for the time being. Accordingly, the Cayuga Indian Nation's pending motion to dismiss property tax foreclosure proceedings initiated against them should be dismissed by the U.S. District Court.
